1. About Ruby Slipper
Ruby Slipper (rubyslipper.net) ("Ruby Slipper," "we," "us") is a storefront where independent filmmakers rent and sell their films directly to viewers. We are not a video host. Filmmakers host their films with a provider such as Bunny.net or Vimeo, and Ruby Slipper plays them on the filmmaker's film page.
These Terms apply to filmmakers who sell films ("Filmmakers") and viewers who rent or buy them ("Customers"). By creating an account or making a purchase, you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy.
2. Who can use Ruby Slipper
- You must be at least 18, or the age of majority where you live.
- Ruby Slipper is available in the United States only, and films can be rented or bought only by Customers in the United States.
- You are responsible for keeping your login secure and for all activity on your account.
3. For Customers
You buy from the Filmmaker. When you rent or buy a film, you are buying directly from the Filmmaker who made it. Payment is processed by Stripe on the Filmmaker's own Stripe account. Ruby Slipper provides the storefront and playback.
Rentals. After renting, you have 30 days to start watching. Once you press play, you can watch for the rental period shown on the film page, either 48 hours or 7 days. When that period ends, access ends.
Purchases. A purchase lets you stream the film from your Ruby Slipper account for as long as the film remains available on Ruby Slipper and your account is in good standing.
Personal viewing only. Rentals and purchases are for personal, non-commercial viewing. You may not share your account, or record, copy, download, rebroadcast, or publicly screen a film.
Refunds. All sales are final. If you have a problem, email hello@rubyslipper.net.
Mailing lists. At checkout you choose whether to join the Filmmaker's mailing list. Our Privacy Policy explains what the Filmmaker receives either way.
4. For Filmmakers
Your account. Provide accurate information when you sign up, including a working email address.
Your rights. You keep full ownership of your films and materials. You confirm that you own or control every right needed to upload, sell, and stream everything you add to Ruby Slipper, including music, footage, images, and the participation of the people who appear in your film.
What you allow us to do. You give Ruby Slipper a non-exclusive, royalty-free license to display your film page, to play your trailer to visitors and your film to Customers who have access, and to use your title, artwork, and description to promote your film on Ruby Slipper and in our marketing. This license ends when you remove your film, except where Customers already have access under section 3 and where the law requires us to keep records.
No exclusivity. You may sell your films anywhere else.
Payments and fees. To sell, you must connect your own Stripe account. Each sale is charged on your Stripe account, and you are the seller. Ruby Slipper's fee is deducted automatically at the time of sale: 10% of the sale price, or 8% for the first 25 Filmmakers who joined with the founders code, for as long as their account stays open. Stripe's processing fees are charged to you under your own agreement with Stripe. We may change our standard fee with at least 30 days' notice by email. A change never applies to sales made before it takes effect, and never changes the founders rate.
Hosting. You are responsible for hosting your films with a provider such as Bunny.net or Vimeo, for its costs, and for keeping its settings compatible with Ruby Slipper.
Prices, refunds, and disputes. You set your prices and rental period. All sales to Customers are final, and Ruby Slipper handles customer questions. Chargebacks and disputes are raised on your Stripe account, and you are responsible for any amounts Stripe reverses. When a charge is disputed or refunded, the Customer's access to that film ends.
Taxes. You are responsible for taxes on your sales, including sales tax where it applies.
Customer information. You may receive Customers' names and email addresses through Stripe, and through your dashboard for Customers who join your mailing list. Use this information only to fulfill orders, provide support, and, for Customers who opted in, send news about your work. Honor unsubscribe requests promptly, follow anti-spam law, and never sell or share this information.
5. Publishing and removal
Films go live when you publish them. We do not review them first. We may suspend or remove any film or account that breaks these Terms or the Acceptable Use Policy, that is the subject of a valid legal complaint, or that we reasonably believe puts Customers, Filmmakers, or Ruby Slipper at risk. Where we can, we will tell you why.
6. Copyright complaints
If you believe material on Ruby Slipper infringes your copyright, email hello@rubyslipper.net with the subject "Copyright notice." Include your contact details, the work you believe is infringed, the link to the material on Ruby Slipper, a statement that you believe in good faith the use is not authorized, a statement that your notice is accurate and, under penalty of perjury, that you are authorized to act for the copyright owner, and your signature. Filmmakers may send a counter-notice. We close the accounts of repeat infringers.
7. Our service
We work to keep Ruby Slipper running well, but we provide it "as is" and "as available," without warranties of any kind, to the extent the law allows. Playback depends on the Filmmaker's hosting provider, your internet connection, and your device. We may change or discontinue features. If we ever close Ruby Slipper, we will give Filmmakers at least 60 days' notice by email.
8. Limitation of liability
To the extent the law allows, Ruby Slipper is not liable for indirect, incidental, or consequential damages, or for lost profits. Our total liability for any claim is limited to the greater of the fees Ruby Slipper earned from you in the 12 months before the claim, or $100.
9. Indemnity
Filmmakers agree to defend and hold Ruby Slipper harmless from claims arising from their films, their materials, or their breach of these Terms.
10. Closing your account
You can close your account at any time by writing to hello@rubyslipper.net. We may suspend or close accounts as described in section 5.
11. Changes to these Terms
We may update these Terms. For significant changes, we will email Filmmakers at least 30 days before they take effect.
12. Governing law
These Terms are governed by the laws of the State of Maine. Any dispute will be heard in the state or federal courts located in Maine.
